Board of Nursing Home Administrators
The Board of Nursing Home Administrators hereby gives notice: that on January 29, 2019, an Order was filed on the Petition for Variance or Waiver. The Petition for Variance or Waiver was filed by Michael Buxton, on October 2, 2018, seeking a variance or waiver of a portion of subsection 64B10-16.003(3), F.A.C., which provides that the skilled nursing facility at which an administrator-in-training program takes place should have at least 60 beds. The Notice of Petition for Variance or Waiver was published in Volume 44, No. 204, of the October 18, 2018 issue of the Florida Administrative Register. No comments were received on the Petition. The Board, at its meeting held on January 11, 2019, by teleconference, voted to grant the Petition for Variance or Waiver with Conditions is granted as a temporary variance of the rule solely for the duration of Petitioner’s service as the nursing home administrator of record at Lutheran Haven and that Petitioner remain in good standing as a certified preceptor without any disciplinary action during this period. The Board further found that Petitioner established the purpose of the underlying statute and that application of the rule, to the circumstances as presented, would violate principles of fairness or impose a substantial hardship on Petitioner.
