NOTICE IS HEREBY GIVEN that on February 15, 2024, the Department of Business and Professional Regulation, Division of Hotels and Restaurants, Bureau of Elevator Safety, received a petition for Surfside Twelve Condominium Association Inc at 585 E Gulf Dr., Sanibel, FL 33957. Petitioner seeks a routine variance of the requirements of ASME A17.1, 2019 Edition, Section 5.7.1, as adopted by 61C-5.001, Florida Administrative Code that requires a Where the hoistway is adjacent to areas permitting passage of people (e.g., passageways, stairwells, elevator landings), it shall be enclosed to a height not less than 2130 mm (84in.) above the floor or stair treads. The enclosure shall be of sufficient strength to prevent contact between the enclosure and the car or counterweight when the enclosure is subjected to a force of 1112 N (250 lbf) applied at right angles at any point over an area of 100 mm x 100 mm (4in. x 4 in.). Openwork enclosures shall be permitted to be used and shall reject a ball 25 mm (1 in.) in diameter. Which poses a significant economic/financial hardship.
