PURPOSE AND EFFECT: Chapter 73C-49, F.A.C., establishes the due dates for the evaluation and appraisal notification letter to be submitted by local government body to the Department. Rule 73C-49.001, F.A.C., sets out the purpose of the rule chapter as establishing due dates, while Rule 73C-49.002, F.A.C., sets the due dates for each local government body. The Department proposes combining the two rules, updating the due dates that have passed with the exception of local governments that have not submitted the letter timely, and removing obsolete language.
SUMMARY: The amended and/or revised rule addresses the schedule for local government bodies to submit their evaluation and appraisal notification letters to the Department.
SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:
The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.
The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: The agency has previously performed a review of the statutory requirements and determined that Rules 73C-49.001-.002, F.A.C., have no adverse impact or regulatory costs which exceed any of the criteria established in Section 120.541(2)(a), Florida Statutes. The movement of the text from Rule 73C-49.002, F.A.C., to Rule 73C-49.001, F.A.C., does not have any impact. These rules are therefore expected to be able to take effect without the need of being ratified by the Legislature.
Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

73C-49.001Purpose and Effect.; Schedule
(1) The purpose of this chapter is to establish the due dates for the evaluation and appraisal notification letter to be submitted by the local governing body and sent to the department pursuant to Section 163.3191(1), F.S. The evaluation and appraisal notification letter is the principal process for updating local comprehensive plans to reflect changes in state requirements in Chapter 163, Part II, F.S., since the last update of the comprehensive plan. The schedule divides the workload for the department over the submittal period and meets the required local governments deadlines set in Section 163.3191, F.S. Local governments which fail to submit the notification letter by their scheduled due date are subject to provisions of Section 163.3191(4), F.S.
(2) Local governing bodies shall submit their evaluation and appraisal notification letter to the Department of Economic Opportunity, Bureau of Community Planning, Caldwell Building, 107 East Madison Street, MSC 160, Tallahassee, FL 32399-6545, Attention Plan Processing Unit, in accordance with the schedule set forth below, and on the same day and month every seven years thereafter:
