The Board of Physical Therapy Practice hereby gives notice of the issuance of a Notice of Intent to Deny Petition for Variance or Waiver of Rule 64B17-3.001, F.A.C., filed on July 7, 2015, by Hector Rodriguez. The Notice of Petition for Variance or Waiver was published in Vol. 41, No. 136, of the July 15, 2015 Florida Administrative Register. The Board considered the Petition at a duly-noticed public meeting on August 7, 2015. The Petitioner sought a waiver of the provision of paragraph 64B17-3.001(1)(g), F.A.C., which requires foreign credentialing evaluations to use original documentation from the institution with institutional seals and signatures.

The Board found Petitioner had failed to demonstrate how he has met the purpose of the underlying statute by other means. Accordingly, the Board voted to deny the Petition for a Variance or Waiver. The Board filed its Notice on August 20, 2015.
