NOTICE IS HEREBY GIVEN that the Board of Physical Therapy Practice has declined to rule on the petition for declaratory statement filed by Everett Harris, PT on July 08, 2015. The following is a summary of the agency’s declination of the petition:

The Board of Physical Therapy Practice hereby gives notice of the issuance of an Order Denying Petition for Declaratory Statement, filed on July 8, 2015, by Everett Harris, PT. The Notice of Petition for Declaratory Statement was published in Vol. 41, No. 136, of the July 15, 2015 Florida Administrative Register. The Board considered the Petition at a duly-noticed public meeting on August 7, 2015. The Petitioner sought a Declaratory Statement interpreting Rule 64B17-6.001, F.A.C., regarding physical therapists and medications in the home health care setting. The Board declined to issue the requested Declaratory Statement, finding that the Petition contained no facts which would allow the Board to determine the Petitioner’s particular set of circumstances. The Board filed its final order on August 20, 2015.
