The Board of Physical Therapy Practice hereby gives notice of the issuance of a Notice of Intent to Deny Petition for Variance or Waiver of Rule 64B17-3.003, F.A.C., filed on December 9, 2014, by Kim Dunleavy. The Notice of Petition for Variance or Waiver was published in Vol. 40, No. 247, of the December 23, 2014 Florida Administrative Register. The Board considered the Petition at a duly-noticed public meeting on February 13, 2015. The Petitioner sought a waiver of the provision of Rule 64B17-3.003, F.A.C., which requires submission of an educational credentialing evaluation directly from the credentialing agency, or submission of a certified copy of the credentialing evaluation used by the physical therapy licensing board of another state.
The Board found that the Petition for Variance and Waiver did not meet the pleading requirements of Section 120.542, F.S. and Rule 28-104.002, F.A.C. The Board denied the Petition for failure to comply with the pleading requirement of the statute and uniform rule. The Board filed its notice on March 5, 2015.
