    61G15-21.007Re-examination

    The Board of Professional Engineers hereby gives notice of the issuance of an Order Denying Petition for Variance or Waiver, of Rule 61G15-21.007, F.A.C., filed on June 23, 2014, by Ricardo De La Guardia. The Notice of Petition for Variance or Waiver was published in Vol. 40, No. 125, of the June 27, 2014 Florida Administrative Register. The Board considered the Petition at a duly-noticed public meeting via teleconference on July 25, 2014. The Petitioner sought a waiver of the provision of Rule 61G15-21.007, F.A.C., and requested to be approved to take the principles and practices examination in Architectural Engineering after having failed the principles and practices examination in Civil Structural five (5) times.

    The Board found that it is only authorized to grant petitions for variances and waivers of its rules, and is not authorized to waive a statutory requirement, specifically Section 471.013(1), Florida Statutes (2014). Further, the Board found that the Petitioner did not show a substantial hardship, nor did he show that the principles of fairness have been violated as required by Section 120.542(2), Florida Statutes. The Board filed its final order on August 18, 2014.
