The purpose of this rule revision is to eliminate paragraph 62-762.421(3)(c), F.A.C., in the Financial Responsibility Rule to remove the financial responsibility requirement for Federal and State aboveground storage tank facilities.

PURPOSE AND EFFECT: The purpose of this rule revision is to eliminate paragraph 62-762.421(3)(c), F.A.C., in the Financial Responsibility Rule to remove the financial responsibility requirement for Federal and State aboveground storage tank facilities.

SUBJECT AREA TO BE ADDRESSED: Paragraph 62-762.421(3)(c), F.A.C., in the Financial Responsibility rule now requires Federal and State agencies with aboveground storage tank systems to obtain and maintain financial responsibility. This paragraph will be removed to maintain historical consistency of the requirements for aboveground storage tank systems with the underground storage tank requirements in Rule 62-761.420, F.A.C.
