NOTICE IS HEREBY GIVEN that the Construction Industry Licensing Board has issued an order disposing of the petition for declaratory statement filed by David J. Brogdon/Pro/Max Construction LLC on May 20, 2014. The following is a summary of the agency’s disposition of the petition:
The Notice of Petition for Declaratory Statement was published in Volume 40, No. 105, of the May 30, 2014, Florida Administrative Register. The petition seeks a declaratory statement regarding Section 489.113(3)(b), Florida Statutes, as to whether a general contractor can shingle the roof of an addition to a house that he did not originally build. The Board’s Order, filed on February 11, 2015, issues a declaratory statement that pursuant to Section 489.113(3)(b), Florida Statutes, a general contractor may not shingle the roof of an addition to a house when the addition is not a new building of his or her own construction. The Board declines to answer the questions as set forth on Page 4 of the Petition.
