NOTICE IS HEREBY GIVEN that the Department of Financial Services, Division of Workers’ Compensation, has received the petition for declaratory statement from Jessup, Inc. The petition seeks the agency’s opinion as to the applicability of Section 440.02(15)(d)1., Florida Statutes (2017), as it applies to the petitioner.
The petition seeks the Department’s opinion that if a provider complies with petitioner’s requirements that the provider will meet the criteria enumerated in subsections 440.02(15)(d)1.(I)-(IV), Florida Statutes. The petition seeks the Department’s opinion whether petitioner may appropriately deem the provider to be an independent contractor and not an employee.
