NOTICE IS HEREBY GIVEN that the Board of Cosmetology has issued an order disposing of the petition for declaratory statement filed by Mark Kilpatrick on October 30, 2014. The following is a summary of the agency’s disposition of the petition:

The Notice of Petition for Declaratory Statement was published in Volume 40, No. 229, of the November 25, 2014, Florida Administrative Register. The petitioner requests clarification as to whether he may lawfully open a personal membership club for adult performers only which shapes body hair, attaches non-piercing jewelry, and applies fake tattoos. The Board’s Order, filed on February 19, 2015, declines to issue a declaratory statement because the petition does not comply with the essential requirements of law.
