    NOTICE IS HEREBY GIVEN THAT the FLORIDA PUBLIC SERVICE COMMISSION has issued an order disposing of the petition for declaratory statement filed by Tesla Inc., on December 3, 2018.  The following is a summary of the agency's disposition of the petition: The Florida Public Service Commission issued a declaratory statement that: (1) Tesla Inc.’s leasing of solar electric equipment to residential lessees, pursuant to Tesla’s standard form lease known as Tesla’s SolarLease,  as described by Tesla’s Petition, will not be deemed to constitute a sale of electricity; (2) Tesla’s offering to lease  solar electric equipment to residential electricity users as described in Tesla’s Petition will not cause Tesla to be deemed a public utility under Florida law; and (3) the residential solar equipment lease, as described by Tesla’s Petition, will not subject either Tesla or Tesla’s customer-lessees to regulation by the Florida Public Service Commission.

    Final Order No. PSC-2019-0065-DS-EQ was issued and filed on February 21, 2019, in Docket No. 20180221-EQ.
