    Notice of Publication for a New Point

    Franchise Motor Vehicle Dealer in a County of More

    than 300,000 Population

    Pursuant to Section 320.642, Florida Statutes, notice is given that American Honda Motor Co. Inc., Division Acura Automobile intends to allow the establishment of TT of AC Melbourne, Inc., as a dealership for the sale of Acura vehicles (line-make ACUR) at Exhibit A Legal Description, The 3.0 acre portion at the south end of Parcel 26-36-09-VI-A-1, between Bromley Drive on the west and Interstate 95 on the east,

    A parcel of land lying in Sections 9 and 10 of Township 26 South, Range 36 East, being a portion of the lands described as Parcel “D” of O.R. Book 4595, Page 0074 of the Public Records of Brevard County, Florida; said subject parcel being more fully described as follows: Commence at the southwest corner of the Southwest ¼ of said Section 10 as monumented by an existing concrete monument by H.H. Wilson as shown on the Florida Department of Natural Resources Certified Corner Record Document No. 0027032; thence N.00'09'04”W., along the west line of said Southwest ¼, a distance of 1716.56 feet to the easterly projection of the south line of the plat of “Napolo Drive”, a variable width public right-of-way as recorded in Plot Book 48, Page 30 of said Public Records; thence S.75'22’17”W., along said easterly projection of the south right-of-way line, also being the southerly line of said Parcel “D”, a distance of 20.51 feet to the southeast corner of said plot; thence N.14'38'37”W., along the east line of said plot, a distance of 200.04 feet to the northeast corner of said plat; thence N.75'10'13”E., a distance of 10.24 feet to the Point-of-Beginning of the lands described herein; thence N.14'34'39”W., parallel with the west right-of-way line of Interstate 95, a 300.00 foot wide public right-of-way as shown on Florida State Road Department Map Section 70220-2408, a distance of 522.87 feet to the point-of-curvature of a 40.00 foot radius concave to the east; thence Northerly, along on arc of said curve, through a central angle of 13'42'57”, an arc distance of 9.58 feet to the point-of-tangency; thence N.00'51’42”W., a distance of 129.51 feet; thence N.75'25'21”E., a distance of 551.36 feet to said west right-of-way line; thence S.14'34'39”E., along said west right-of-way line, a distance of 717.39 feet to the arc of a non-tangent, 2450.00 foot radius curve concave to the north which has a chord bearing and a chord distance of S.83'35'47”W, and 30.30 feet; thence Westerly, along on arc of said curve and 200.00 feet northerly, by concentric measure, of said southerly line of Parcel “D”, through a central angle of 00'42'31”, an arc distance of 30.30 feet to the southeast corner of the lands as described in O.R. Book 4784, Page 0207 of said Public Records; thence along the east, north and west lines respectively, of said lands per O.R. Book 4784, Page 0207, the following three (3) courses; N.14'34'39”W., parallel with said west right-of-way line, a distance of 36.69 feet; S.7525'21”W., a distance 30.00 feet; S. 14'34'39”E., parallel with said west right-of-way line, a distance of 30.00 feet to the arc of said non-tangent 2450.00 foot radius curve concave to the north which now has a chord bearing and a chord distance of S.85'29'18”W, and 70.75 feet; thence Westerly, along an arc of said curve and 200.00 feet northerly, by concentric measure of said southerly line of Parcel “D”, through central angle of 01'39'17”, an arc distance of 70.76 feet to a point-of-reverse curvature of a 2100.00 foot radius curve concave to the south; thence Westerly, along an arc of said curve and 200.00 feet northerly, by concentric measure of said southerly line of Parcel “D”, through a central angle of 10'52'23”, an orc distance of 398.52 feet to a point-of-tangency; thence 5.75'26'34”W., parallel with and 200.00 feet northerly, by right angle measure, of said southerly line of Parcel “D”, a distance of 57.43 feet to the Point-of-Beginning. Containing 9.00 acres (392,165 square feet), more or less.

    The notice indicates intent to establish the new point location in a county of more than 300,000 population, according to the latest population estimates of the University of Florida, Bureau of Economic and Business Research. Certain dealerships of the same line-make may have standing, pursuant to Section 320.642, Florida Statutes, to file a petition or complaint protesting the application.

    Written petitions or complaints must be received by the Department of Highway Safety and Motor Vehicles within 30 days of the date of publication of this notice and must be submitted to: Jaime Williams, Administrator, Dealer License Section, Department of Highway Safety and Motor Vehicles, Room A-312 MS65, Neil Kirkman Building, 2900 Apalachee Parkway, Tallahassee, Florida 32399-0635.

    A copy of such petition or complaint must also be sent by US Mail to: Jason Bracken, Acura Automobile Division of American Honda Motor Co. Inc., 1500 Morrison Parkway, Alpharetta, Georgia 30009.

    If no petitions or complaints are received within 30 days of the date of publication, a final order will be issued by the Department of Highway Safety and Motor Vehicles approving the establishment of the dealership, subject to the applicant's compliance with the provisions of Chapter 320, Florida Statutes.
