    64B13-4.001Examination Requirements

    The Board of Optometry hereby gives notice: of the issuance of an Order regarding the Petition for Waiver or Variance, which was filed on December 11, 2019, by Shawn D. Westbrook, O.D. Petitioner was seeking a waiver or variance from subsection 64B13-4.001(1), F.A.C., entitled, “Examination Requirements” that states an applicant for licensure must achieve a passing score on all four (4) parts of the licensure examination in order to be licensed in Florida. The Notice was published in Volume 45, No. 243, of the Florida Administrative Register, on December 17, 2019.

    The Board considered the instant Petition at a duly-noticed meeting held January 17, 2020, in Orlando, Florida. The Board’s Order, filed on February 11, 2020, granted the petition finding that Petitioner had established that the purpose of the underlying statute would be met by granting a variance or waiver from subsection 64B13-4.001(1), F.A.C. The Board further finds that Petitioner established that applying the requirements of the aforementioned rule to his circumstances would violate principles of fairness and impose substantial hardship.
