    NOTICE IS HEREBY GIVEN that the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has received the petition for declaratory statement from Elena Soutullo, In Re: 5825 Corinthian Condominium Association, Inc., Docket No. 2018009614, filed on February 22, 2018. The petition seeks the agencys opinion as to the applicability of Sections 718.113(1), 718.113(2), 718.113(5), 718.110(4), 718.110(9), 718.111, 718.119, 718.303, and 718.504, Florida Statutes, as they apply to the petitioner.

    Whether the Board of Directors has the authority to negotiate and unilaterally make decisions regarding maintenance, additions, alterations and improvements to common elements, limited common elements and “appurtenances” to units; whether the original 1979 or amended 2001 version of the Declaration is valid and enforceable; and whether the maintenance of the common elements and the limited common elements are the responsibility of the association; pursuant to Sections 718.113(1), 718.113(2), 718.113(5), 718.110(4), 718.110(9), 718.111, 718.119, 718.303, and 718.504, Florida Statutes?
