    Notice is hereby given that the Board of Osteopathic Medicine has received a Petition for Declaratory Statement filed on behalf of Florida Hospices and Palliative Care, Inc., on January 19, 2012. The Petitioner requests the Board’s interpretation of Section 456.44, Florida Statutes, as created in Section 3 of Chapter 2011-141, Laws of Florida. Specifically, the Petitioner seeks the Board’s interpretation of the applicability of the statute to the prescribing of controlled substances by physicians licensed under Chapter 459, F.S., in connection with the provision of palliative care to patients served by a hospice or an entity that is controlled by or under common control with a hospice. The Board will consider this petition at its meeting scheduled for February 17-18, 2012, in Ft. Lauderdale, Florida.
