    The Department of Business and Professional Regulation, Division of Drugs, Devices and Cosmetics hereby gives notice that an order has been issued disposing of the petition for variance and waiver filed by Baptist Hospital, Inc., on October 31, 2014.

    The following is a summary of the agency’s disposition of the petition:

    The petitioner is seeking a variance and waiver from the requirements of subsection 61N-1.023(2), F.A.C.

    Granting the petition for variance/waiver would not remove the safety provisions of the Rule and would sufficiently protect the public.

    Petitioner’s request for a waiver from the limitation in subsection 61N-1.023(2), F.A.C., that prescription drug transfers are limited to those made to a facility under common control licensed with a pharmacy permit that authorizes the acquisition and possession of prescription drugs, is granted. Petitioner may transfer prescription drugs to its wholly-owned Physician Office Locations as described in the Petition.
