The Board of Physical Therapy Practice hereby gives notice:

Lekha J. Samuel, PT, DPT, filed a Petition for Variance or Waiver on October 6, 2014, which was published on November 26, 2014, in Vol. 40, No. 230, of the Florida Administrative Register. Petitioner sought a variance or waiver of Rule 64B17-3.003, F.A.C., which requires that applicants for licensure by endorsement meet the educational requirements of Rule 64B17-3.001, F.A.C., specifically, that Petitioner has received a determination that her educational credentials are deemed equivalent to those of a U.S.-educated physical therapist. The Board considered the Petition at a duly-noticed public meeting held on November 7, 2014, in Tampa, Florida.

The Board’s Order, filed December 12, 2014, approved the petition finding that Petitioner is an applicant for licensure by endorsement and is therefore governed by Rule 64B17-3.003, F.A.C., and she has demonstrated: a) she meets the purpose of the underlying statute by other means; b) a substantial hardship; c) application of the rule at issue would violate principles of fairness.
