  • NOTICE IS HEREBY GIVEN THAT the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has declined to rule on the petition for declaratory statement filed by Armand A. Passaretti, Unit Owner, In Re: Somerset Condominium Coordinating Committee, Inc., on November 19, 2010. The following is a summary of the agency's declination of the petition:
    The Division declined to issue a declaratory statement because it cannot issue a statement where the action complained of has already taken place; or when the remedy is to invalidate a bylaw or provision in the governing documents; or when the division did not have competent substantial evidence because it has not been provided a complete current set of governing documents.
