NOTICE IS HEREBY GIVEN that the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has received the petition for declaratory statement from Joseph T. Rambler. The petition seeks the agency's opinion as to the applicability of paragraphs 718.111(13)(a), 718.111(13)(d) and subparagraph 718.112(2)(d)4, Florida Statutes, as it applies to the petitioner.
1. Whether pursuant to paragraphs 718.111(13)(a) and 718.111(13)(d), Florida Statutes, the association is permitted to waive the required year-end audit without a properly called meeting including members that have a voting interest before the end of the fiscal year. 2. Whether pursuant to subparagraph 718.112(2)(d)4., Florida Statutes, the association is permitted to use email and written agreements to vote on waiving the required year-end audit.
