    Construction Industry Licensing Board

NOTICE IS HEREBY GIVEN that Construction Industry Licensing Board has received the second amended petition for declaratory statement from Brian Miller and Alan Brotz. The second amended petition seeks the agency’s opinion as to the applicability of subsection 61G4-12.011(16), F.A.C., as it applies to petitioners. Petitioners’ second amended petition, filed January 12, 2018, seeks a determination from the Board regarding whether a licensed pool/service contractor can install or replace an electrical circuit on the load side of the dedicated pool equipment disconnect panel in the course of installing or replacing a piece of pool equipment: for example, a pump, chlorine generator, light, automated control system, time clock, heater, or any other pool related equipment that requires electrical wiring. This would entail one or more of the following: a) installing or replacing the wiring between the pool equipment and the local pool circuit breaker panel; b) installing or replacing the circuit breaker protecting said pool equipment; and c) installing and wiring an electrical piece of pool related equipment such as an automated control system, solar controller, timeclock, or any other piece of pool equipment that requires electrical wiring. Except for good cause shown, motions for leave to intervene must be filed within 21 days after publication of this notice.
