40E-6.011: Policy and Purpose

NOTICE IS HEREBY GIVEN THAT on January 17, 2008, the South Florida Water Management District (District), received a petition for waiver from Paul Sands, Jr., Application No. 07-1204-1, for utilization of Works or Lands of the District known as the C-1W Canal, Miami-Dade County, for four (4) existing trees located 36-37 feet from top of bank along east right of way of C-1W canal, Section 35, Township 55 South, Range 39 East. The petition seeks relief from subsections 40E-6.011(4) and (6), Florida Administrative Code, which governs the placement of permanent and/or semi-permanent above-ground encroachments within 40 feet from the top of bank within Works or Lands of the District.
