The Division of Licensing hereby gives notice:

On February 4, 2016, the Department issued an Order granting a Petition for Variance filed by Invictus, Inc., on November 6, 2015. Notice of the Petition was published on November 13, 2015, in Volume 41, No. 221, of the Florida Administrative Register.

Petitioner sought a permanent variance from paragraph (1)(b) of Rule 5N-1.140, F.A.C, asking to administer more than the two examinations required by rule, at various intervals throughout the training course, while meeting remaining rule requirements. The Division’s order granted Invictus the variance it sought. However, to fully effectuate Petitioner’s request, the Division also granted a variance from paragraph (1)(c) of the rule, as it also establishes requirements relative to the two examinations. Without a variance to (1)(c), Petitioner would still find itself constrained by a rule provision requiring a two-part exam, thus frustrating the purpose behind its variance request. Petitioner will now be able to provide more than two examinations at various intervals, consisting of a total of 170 questions, of which 128 questions must be answered correctly.
