    11B-27.002Certification, Employment or Appointment, Reactivation, and Terminating Employment or Appointment of Officers

    NOTICE IS HEREBY GIVEN that on January 7, 2016, the Criminal Justice Standards and Training Commission, received a petition for temporary waiver of subsection 11B-27.002(4), F.A.C. from Deputy Chief Sean Brammer of the Florida Atlantic University Police Department on behalf of Howard Jenkins. Petitioner wishes to temporarily waive that portion of the rule that states: Within four years of the beginning date of a Commission-approved Basic Recruit Training Program, an individual shall successfully complete the program, achieve a passing score on the applicable State Officer Certification Examination, and gain employment, and certification as an officer. Petitioner states that Mr. Jenkins successfully began a Commission-approved Basic Recruit Training Program on October 17, 2011 and successfully completed the program on April 16, 2012. Petitioner states that Mr. Jenkins passed the State Officer Certification Examination on April 24, 2012. Petitioner states that due to an administrative error, Mr. Jenkins was considered for a law enforcement officer position and a thorough background investigation was conducted under the mistaken belief that he had until April 16, 2016 to be employed as a law enforcement officer.

    Petitioner states that due to the administrative error, the applicant was hired on December 21, 2015 in a Temporary Employment Authorization status. Petitioner states that strict application of the rule creates a substantial hardship for both the petitioner and Officer Jenkins. Petitioner states the purpose of the underlying statute will be achieved if the waiver is granted.
