NOTICE OF CHANGE

Notice is hereby given that the following changes have been made to the proposed rule in accordance with subparagraph 120.54(3)(d)1., F.S., published in Vol. 46 No. 227, November 20, 2020 issue of the Florida Administrative Register.

The changes to the Applicant’s Handbook for Water Use Permit Applications within the South Florida Water Management District include Section 3.11.6, Everglades Agricultural Area (EAA) Reservoir that became effective on January 31, 2021; adding the effective date to references to incorporated forms and materials in proposed Sections 3.11.5 and 5.2.2.K.9; and changes to paragraph references in proposed Sections 3.11.5 and 5.2.2.K.9 due to the rule amendment to Rule 40E-10.021, F.A.C., that became effective on January 31, 2021. The District’s Upper Kissimmee-Operations Simulation (UK-OPS) Model (Version 3.12P), is also added as a publication incorporated by reference, in accordance with proposed Subsection 3.11.5 B.2.b. The changes to Forms 1392 and 1393, incorporated by reference in subsections 40E-2.091(2)(g) and (h), include a statement that the form and its contents will be considered a public record. There is no change to the rule text incorporating these forms.

The changes to the Applicant’s Handbook, the UK-OPS Model, and revised Forms 1392 and 1393 are available on the District’s website at https://www.sfwmd.gov/our-work/water-reservations.
