    PURPOSE AND EFFECT: The purpose and effect of this rulemaking is for the Department of Financial Services to establish a procedure for the licensure of a customer service representative relating to insurance representatives pursuant to section 626.171, Florida Statutes.

    SUMMARY: This rulemaking addresses the licensure of customer service representatives pursuant to section 626.171, Florida Statutes.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: The Department’s economic review for this rulemaking.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

    (7) An applicant for a resident customer service representative, which does not require examination for licensure, shall complete and submit Form DFS-H2-0100, “4-40 Resident Customer Service Representative,” effective MM/YY, which is incorported herein by reference, according to the instructions therein. To access Form DFS-H2-0100, the applicant must create a MyProfile account at https://dice.fldfs.com/public/pb_index.aspx and submit the license application through the department’s online portal. A copy of the form can be found at https://www.flrules.org/gateway/_____ An applicant for licensure for which no examination is required shall complete and submit Form DFS-H2-499, “Insurance License Application/No Examination Required,” rev. 3/97.
