61J1-8.003Notice of Noncompliance

The Florida Real Estate Appraisal Board hereby gives notice that on February 19, 2016, an Order was filed on the Petition for Waiver or Variance. The Petition for Waiver or Variance was filed by William Terry Hanes, on November 9, 2015, seeking a waiver or variance from Rule 61J1-8.003, F.A.C., with regard to the requirement that only certain rules be considered minor violations for which DBPR shall provide a registrant, licensee or certificate holder with a notice of noncompliance. The Notice was published in Volume 41, No. 228, of the Florida Administrative Register, on November 24, 2015. The Board, at its meeting held on December 7, 2015, voted to deny the Petition for Waiver or Variance finding that the Petitioner did not demonstrate a substantial hardship; that application of the rule did not violate the principles of fairness; and that the purpose of the underlying statute had not been met.
