    NOTICE IS HEREBY GIVEN that the Board of Podiatric Medicine has received the petition for declaratory statement from Edward L. Golden, Personal Representative of Kevin Berkowitz, D.P.M., deceased, filed on February 14, 2017. The petition seeks the agencys opinion as to the applicability of Rule 64B18-15.001 F.A.C., as it applies to the petitioner.

    Petitioner seeks to know the soonest medical records can be disposed of or destroyed where the required notice was not published within one month of the death of the podiatric physician and whether the requirements of Rule 64B18-15.001(3), F.A.C., controls where it had been more than four years since the date of the a patient’s last appointment with the podiatric physician at the time of the podiatric physician’s death. Except for good cause shown, motions to leave to intervene must be filed within 21 days after the publication of this notice.
