    62B-33.002Definitions

    The Department of Environmental Protection hereby gives notice that it has issued an Order on February 25, 2016, granting Terry Posmer’s Petition for a Variance. The Petition was received on December 1, 2015. Notice of receipt was published in the Florida Administrative Register on December 17, 2015; Vol. 41, No. 243. The Petitioner requested a variance or waiver from subsections 62B-33.002(18) and 62B-33.002(43), and subparagraph 62B-33.0051(1)(a)1, F.A.C., which requires that in order to qualify for a permit for coastal armoring, the structure proposed to be protected must be an eligible structure. No public comment was received. The Order, file number FR-925 AR V, granted the Petitioner a variance from subsections 62B-33.002(18) and 62B-33.002(43), and subparagraph 62B-33.0051(1)(a)1, F.A.C., based on a demonstration by the Petitioner that he would suffer a substantial hardship if the variance or waiver was not granted.
