PURPOSE AND EFFECT: In addition to deleting unnecessary language for nonexistent wilderness/expedition programs, the amendment clarifies the required timing of on-site visits for Designated Health Authorities.
SUMMARY: The amendment deletes unnecessary language, and requires that no more than 9 days pass between weekly, on-site visits of the Designated Health Authority in juvenile delinquency programs and facilities.
SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:
The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.
The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: The SERC Checklist, and current information available to the Department, indicates that the statutory threshold for ratification will not be exceeded.
Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

63M-2.0031 Designated Health Authority.
(1) No change.
(2) The role and function of the Designated Health Authority shall be clearly articulated in a written contract or agreement between the facility or program and the Designated Health Authority.
(3) The contract shall clearly indicate:
(a) At a minimum, the DHA must be on-site once per week, with a week defined as the seven-day period beginning on Sunday and ending on Saturday. However, at no time will more than nine days pass between on-site visits. For wilderness/expedition programs, the DHA shall be on-site at the facility once bi-weekly, at a minimum; during the weeks that the DHA is not on-site, the DHA will be available at an off-site location to perform the duties as stated in the contract and this rule.
