    NOTICE IS HEREBY GIVEN that the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has received the petition for declaratory statement from P. Scott Maxwell, In Re: Quatraine Condominium II Association, Inc., Docket No. 2020008531.The petition seeks the agency's opinion as to the applicability of Chapters 718 and 720, F.S. as it applies to the petitioner.

    1. Should the association be classified as a homeowners’ association as defined in Chapter 720, Florida Statutes, a condominium association as defined in Chapter 718, Florida Statutes, or if neither, then as what type of legal entity? 2. What are the correct and applicable and statutory election requirements, methodologies, and administrative procedures related to the noticing and holding of annual meetings, and the election of members of the board of administration that must be followed by the association? 3. What procedures found in the association’s governing documents pertaining to the election of members to the board of administration, and the holding of annual meetings by the association, if any, should be considered applicable and mandatory?
