NOTICE IS HEREBY GIVEN THAT the Board of Pharmacy has issued an order disposing of the petition for declaratory statement filed by Kirk Peterson, on behalf of Wellfount Corporation, on August 23, 2010. The following is a summary of the agency's disposition of the petition:
The Notice of Petition for Declaratory Statement published on November 24, 2010, in Vol. 36, No. 47, of the Florida Administrative Weekly. Petitioner sought the Boards interpretation of Rule 64B16-28.606, F.A.C., entitled, Remote Medication Order Processing for Class II Institutional Pharmacies, and whether Wellfount Corporation can use a remote medication system in the nursing home setting and whether that system needs to be operated by a pharmacist licensed in Florida. The Board of Pharmacy considered the Petition at its meeting held on December 14, 2010, in Gainesville, Florida. The Boards Order filed on January 5, 2011, found that the petition should be denied for failing to state sufficient facts for the Board to issue a declaratory statement.
