NOTICE IS HEREBY GIVEN that the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has issued an order disposing of the petition for declaratory statement filed by William C. Guthrie, Esq., In Re: The Fountains Vacation Club, LLC, Docket No. 2014047649, on November 12, 2014. The following is a summary of the agency’s disposition of the petition:

The Fountains Vacation Club is neither a “timeshare plan” nor a “multisite timeshare plan” within the meanings of Sections 721.05(39) and 721.52(4), Florida Statutes, and therefore is not subject to the Division’s jurisdiction.
