NOTICE IS HEREBY GIVEN that the Department of Health received the petition for declaratory statement from Seacrest Beach II Owner’s Association, Inc. (Seacrest) on December 29, 2015. The petition seeks the agency’s opinion as to the applicability of Rules 64E-9.013 and 64E-10.002, F.A.C., as they apply to the petitioner. Petitioner is seeking a determination of the applicability of these rules as it applies to a beach access easement property that provides access to the beach for Seacrest and surrounding property owners. Motions for leave to intervene must be filed within 21 days of publication and must contain the information required in subsection 28-105.0027(2), Florida Administrative Code.
