  • NOTICE IS HEREBY GIVEN THAT the Division of Pari-Mutuel Wagering, Department of Business and Professional Regulation, has issued an order disposing of the petition for declaratory statement filed by Richmond Entertainment, Inc. (d/b/a Hamilton Jai Alai), and Amtote International, Inc. (Petitioners), and Investment Corp. of Palm Beach (d/b/a Palm Beach Kennel Club), St. Petersburg Kennel Club, Inc. (d/b/a Derby Lane), Jacksonville Kennel Club, Inc., Orange Park Kennel Club, Inc., and Bayard Raceways, Inc. (d/b/a St. Johns Greyhound Park) (Intervenors), on July 07, 2008. The following is a summary of the agency's disposition of the petition:
    The petition for declaratory statement was noticed in Vol. 34, No. 30, Florida Administrative Weekly. It sought advice on whether the pari-mutuel system of Instant Racing, an automated means of making pari-mutuel wagers on rebroadcast racing events, would be authorized for use in the State pursuant to Chapter 550, F.S. The declaratory statement issued by the Division (DBPR Case No. 20080387361/DS 2008-046) on February 26, 2009, finds that, while Instant Racing is a pari-mutuel wagering system with sufficient safeguards to ensure fairness and integrity for those playing, it does not fit within the statutory framework of Chapter 550, F.S., because it involves wagering on already run historic races, not live contemporaneous races. Accordingly, under Chapter 550, F.S., the Instant Racing system is not authorized to be employed in the state.
