    The Board of Opticianry hereby gives notice that it has received a petition for Declaratory Statement, filed on February 3, 2009, by Anthony D. Record, a Florida licensed optician. The Petitioner seeks the Board’s guidance regarding several issues relating to Section 484.002(9), Florida Statutes, regarding Optical Dispensing. Specifically, this includes a request as to: (1) Whether an unlicensed employee, with or without the direct supervision of an optician, could help a customer/patient pick out frames; (2)(a) In the case where a patient arrives to pickup glasses, is fully fitted by the optician, then realizes she forgot her wallet and asks if her husband can pick up glasses, can the glasses be delivered to the husband without the wife present? (b) If the frames that are selected at the time of initial sale are adjusted, can the glasses be handed to the wearer or agent of the wearer by a non-licensed employee?; and (3) Is an Insertion and Removal session (contact lens instruction) excluded from Optical Dispensing? Can an unlicensed person provide such instruction without supervision of an optician?

    The Board will address this Petition at its next meeting.
