NOTICE IS HEREBY GIVEN that the Department of Health has received the petition for declaratory statement from Benjamin DeMarsh, on behalf of property owners Stuart Newman and Sandi Boerum (Petitioners). The petition seeks the agency’s opinion as to the applicability of Rule 64E-8.001, as it applies to the petitioner.
Petitioners intend to operate their home, located in Manatee County, as an AirBnb renting out up to three bedrooms on a short-term basis. Petitioners believe that the water well supplying water to the home should not be classified as a limited use public water supply under Rule 64E-8.001, of the Florida Administrative Code and should instead be classified as a private potable well under Rule 64E-6.002, of the Florida Administrative Code.
