NOTICE IS HEREBY GIVEN that the Board of Physical Therapy Practice has issued an order disposing of the petition for declaratory statement filed by Jessica D. Smith on December 20, 2012. The following is a summary of the agency's disposition of the petition:
The Notice of Petition for Declaratory Statement was published in Vol.39, No. 10, of the July 13, 2012, Florida Administrative Register. The Board considered the Petition at a duly-noticed public meeting held on February 8, 2013. The Petitioner did not state in her request which statute the Petitioner was seeking the Board to interpret. However, it appeared that Petitioner was requesting and interpretation of Chapter 486.021, Florida Statutes, and whether staple removal is within the scope of practice for physical therapist assistants. The Board’s Order, filed on march 4, 2013, denies the Petition for Declaratory Statement. The Petition is asking for clarification of the statutory provisions and rules to determine conduct that has general applicability to all physical therapist assistants. This type of clarification in not appropriate for determination by declaratory statement.
