  • NOTICE IS HEREBY GIVEN that the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has declined to rule on the petition for declaratory statement filed by Shawn G. Brown, Esq., In Re: Bel Mare Condominium Association, Inc., Docket No. 2011042046 on March 14, 2012. The following is a summary of the agency's declination of the petition:
    The division declined to issue a Declaratory Statement because the Division does not have authority to interpret ambiguity in the condominium documents; nor is it within the Division’s jurisdiction to address how the Association and affected parties should remedy their disputes.
