64B14-4.115Requirements for Renewal of Prosthetic or Orthotic Residency or Internship

The Board of Orthotists & Prosthetists hereby gives notice: of the issuance of an Order regarding the Petition for Waiver or Variance, which was filed on January 7, 2020, by Brian V. Narin. The Notice of Petition for Waiver or Variance was published in Volume 46, Number 23, of the February 4, 2020, Florida Administrative Register. The Petitioner was seeking a waiver or variance of Rule 64B14-4.115, Florida Administrative Code, entitled, “Requirements for Renewal of Prosthetic or Orthotic Residency or Internship” which states that for an applicant to be eligible for a one (1) year renewal, the applicant must submit a renewal application to the department no earlier than 150 days prior to the expiration of the active residency or internship.

The Board considered the instant Petition at a duly-noticed public telephonic meeting held January 15, 2020, in Tallahassee, Florida. The Board’s Order, filed on March 5, 2020, granted the petition finding that Petitioner had established that the purpose of the underlying statute would be met by granting a variance or waiver from Rule 64B14-4.115, Florida Administrative Code. The Board further finds that Petitioner established that applying the requirements of the aforementioned rule to his circumstances would violate principles of fairness and impose substantial hardship.
