The Board of Accountancy hereby gives notice: of the issuance of an Order regarding the Petition for Waiver or Variance, filed on December 10, 2018, by Benjamin Kincaid. The Notice of Petition for Waiver or Variance was published in Vol. 45, No. 03, of the January 4, 2019, Florida Administrative Register. Petitioner sought a waiver or variance of subsection 61H1-27.001(5), F.A.C., entitled “College or University Requirements,” that provides that a graduate of a four-year degree granting institution not accredited at the time the applicant’s degree was received or at the time of filing application will be deemed to be a graduate of a four-year accredited college or university course provided an accredited college or university as defined by subsections 61H1-27.001(1) and (2), F.A.C., accepts applicant’s non-accredited baccalaureate degree and the applicant satisfactorily completes at least 15 semester or 22 quarter hours, or the equivalent, in post-baccalaureate education at the accredited institution of which at least 9 semester or 13 quarter hours, including at least 3 semester or 4 quarter hours in taxation; or the equivalent, shall be in accounting.
The Board considered the instant Petition at a duly-noticed public meeting, held February 1, 2019, in Orlando, Florida. The Board’s Order, filed on March 6, 2019, denied the petition finding that Petitioner had failed to establish that the purpose of the underlying statute, Section 473.306, Florida Statutes, would be met by granting a variance from subsection 61H1-27.001(5), F.A.C. The Board further found that Petitioner failed to establish that applying the requirements of the aforementioned rule to his circumstances would violate principles of fairness and impose substantial hardship.
