The Board of Dentistry hereby gives notice:
of the issuance of an Order regarding the Petition for Variance or Waiver, filed on January 10, 2024, by Daniel S. Winokur, D.M.D. The Notice of Petition for Variance or Waiver was published in Vol. 50, No. 11, of the January 17, 2024, Florida Administrative Register. Petitioner sought a variance from or a waiver of Rule 64B5-14.0025(2)(b), F.A.C, which requires documentation of actual clinical administration of anesthetics to 20 dental or oral and maxillofacial patients within two (2) years prior to application of the particular type of anesthetics for the permit applied for The Board considered the instant Petition at a duly noticed public meeting held on February 16, 2024, in Ft. Myers, Florida. The Board Order was filed on March 5, 2024. The Board hereby finds that the Petitioner has met his burden under Section 120.542, F.S., and that a waiver of Rule 64B5-14.0025(2)(b), F.A.C., be granted but only under the condition that he demonstrates successful completion of the AAOMS National Simulation Program Office-Based Emergency Airway Management Module prior to the issuance of the anesthesia permit.
