64B5-17.013:Proprietorship by Nondentists
The Board of Dentistry hereby gives notice:
of the issuance of an Order regarding the Petition for Variance or Waiver, filed on September 20, 2023, by Centurion of Florida, LLC. The Notice of Petition for Variance or Waiver was published in Vol. 49, No. 186, of the September 25, 2023, Florida Administrative Register. Petitioner sought a variance from or a waiver of Rule 64B5-17.013 (1), F.A.C, which states that no corporation, lay body, organization, or individual other than a licensed dentist or a professional corporation or limited liability company composed of dentists shall engage in the practice of dentistry through the means of engaging the services, upon a salary, commission, or other means of inducement, of any person licensed to practice dentistry in this state. The provisions of this rule are not applicable to dentists working under any of the settings described in section 466.025, F.S. The Board considered the instant Petition at a duly noticed public meeting held on November 17, 2023, in Gainesville, Florida. The Boards Order, filed on December 12, 2023, hereby finds that Petitioner has failed to demonstrate that it proposed arrangement would meet the purpose of the underlying statute and that the application of the rule to its circumstances would create substantial hardship or would violate principles of fairness. Accordingly, the petition for variance and waiver of Rule 64B5-17.013(1), F.A.C., is hereby Denied.
