    PURPOSE AND EFFECT: The purpose and effect of the proposed amendments are to repeal rules related to school sanitation. These rules are now within the authority of the Department of Education and this chapter no longer has statutory authority.

    SUMMARY: Rule 64E-13.001, F.A.C. provides a general statement as to the scope of the rule and addresses conflicts with the Uniform Building Code for Public Education Facilities. Rule 64E-13.004, F. A. C. provides the standards and minimum requirements for school sanitation and safety for schools of the state. Rules of the Department of Education now provide for these standards. These rules are not incorporated in other rules and the repeal of these rules will not have an effect on other rules.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION: The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: the SERC checklist does not indicate that the statutory threshold for ratification will be exceeded. Any person who wishes to provide information regarding the statement of estimated regulatory costs, or to provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.
