NOTICE IS HEREBY GIVEN THAT the Department of Business and Professional Regulation has declined to rule on the petition for declaratory statement filed by the Gulf Waters RV Homeowner’s Association, Inc. on March 12, 2008. The following is a summary of the agency's declination of the petition:

Denied because the petition sought statutory interpretation of the real estate practice act, Chapter 475, F.S., and should be properly addressed to the Florida Real Estate Commission, not the Department of Business and Professional Regulation. In addition, the Department is not governed by nor does it have authority to interpret Chapter 513, F.S., as requested in the petition.
