NOTICE OF CHANGE
Notice is hereby given that the following changes have been made to the proposed rule in accordance with subparagraph 120.54(3)(d)1., F.S., published in Vol. 41 No. 131, July 8, 2015 issue of the Florida Administrative Register.
A previous Notice of Change published in Vol. 41, No. 220, of the November 12, 2016 issue of the Florida Administrative Register. The changes are in response to written comments submitted by the staff of the Joint Administrative Procedures Committee and a vote by the Board at a duly noticed public meeting held on February 11, 2016. The changes are as follows:
64B4-3.001 Application for Licensure for Clinical Social Work, Marriage and Family Therapy and Mental Health Counseling Applicants.
Every applicant for licensure as a clinical social worker, marriage and family therapist or mental health counselor shall submit to the Board a completed application on Form DH-MQA 1174, Application for Licensure (revised 02/16 10/15 ), hereby adopted and incorporated by reference, which can be obtained from http://www.flrules.org/Gateway/reference.asp?No=Ref- or the web at http://www.floridasmentalhealthprofessions.gov/resources. The application shall be accompanied with the application fee and the initial licensure fee.

The following changes have been made to incorporated form DH-MQA 1174, (Rev. 02/16):
On the second page of the instructions, third paragraph, the comma between “current” and “driver’s license” has been deleted.
On the third page of the instructions, part III, the word “non-refundable” has been removed regarding the application fee.
On page 1 under the heading “Applicant Profile Data,” the question requesting date of birth is now optional to answer.
On page 3 part V.D., the question “Are you now or have you ever been a defendant in civil litigation in which the basis of the complaint against you was alleged negligence, malpractice or lack of professional competence?” has been removed from the form.
On page 5 part VIII, third paragraph, the citation to section 775.085 has been changed to 775.084.
Rule 64B4-3.009, F.A.C., shall now read as follows:
64B4-3.009 Limited Licenses.
(1) No change.
(2) Any person desiring to obtain a limited license shall submit a completed application to the Board on Form DH-MQA 1178, Application for Limited Licensure (Revised 02/16 10/15), hereby adopted and incorporated by reference, which can be obtained from http://www.flrules.org/Gateway/reference.asp?No=Ref- or the Board’s website at http://www.floridasmentalhealthprofessions.gov/resources . The application shall be accompanied by the documents required by Section 456.015(2), F.S., and a fee of $25 unless the applicant provides a notarized statement from the employer stating that the applicant will not receive monetary compensation for service involving the practice of his profession.

The following changes have been made to incorporated form DH-MQA 1178, (Rev. 02/16):
On page 1 under the heading “Applicant Profile Data,” the question requesting date of birth is now optional to answer.
On page 1 under the heading “Applicant Profile Data,” the question requesting an email address is now optional and states that if an email address is provided, it will become public record.
On page 2 under the heading “Licensure Data,” the requirement for a “letter of intention to employ” has been removed from the form.
On page 2 under the heading “Licensure Data,” the reference to section 456.015 has been changed to 456.035.
On page 2 part 4.D., the question “Are you now or have you ever been a defendant in civil litigation in which the basis of the complaint against you was alleged negligence, malpractice or lack of professional competence?” has been removed from the form.
On page 4 part 6., under the heading “Certification,” third paragraph, the citation to section 775.085 has been changed to 775.084.
Rule 64B4-3.010, F.A.C., shall now read as follows:
64B4-3.010 Marriage and Family Therapy Dual Licensure.
Any psychologist licensed under Chapter 490, F.S., or clinical social worker or mental health counselor licensed under this chapter, or any advanced registered nurse practitioner certified under Section 464.012, FS, and determined by the Board of Nursing to be a specialist in psychiatric mental health, desiring to obtain licensure as a marriage and family therapist shall submit a completed application to the Board on Form DH-MQA 1177, Marriage and Family Therapy Dual Licensure Application (Revised 02/16 10/15), hereby adopted and incorporated by reference, which can be obtained from http://www.flrules.org/Gateway/reference.asp?No=Ref- or the Board’s website at http://www.floridasmentalhealthprofessions.gov/resources. The application shall be accompanied with the application fee and the initial active status license fee specified in Rule 64B4-4.002, F.A.C.
