Notice of Extension Pursuant to Section 120.74(5), Florida Statutes
The Department of Highway Safety and Motor Vehicles (“Department”) identified Section 320.02, Florida Statutes, in its 2018-2019 regulatory plan (“regulatory plan”) as a law requiring implementation by rulemaking. The Department published a notice of rule development for Rule 15C-21.001 (the rule implementing this law) in Vol. 44, No. 206, of the Florida Administrative Register on October 22, 2018. However, the Department must obtain Cabinet approval before proceeding with the publication of a notice of proposed rule. Therefore, pursuant to subsection 120.74(5), Florida Statutes, the Department hereby extends the April 1 deadline to publish a notice of proposed rule for this rulemaking proceeding.
In addition, the Department has determined that rulemaking is not required to implement Section 318.1451, Florida Statutes, which was also identified in its regulatory plan. Pursuant to paragraph 120.74(1)(c), Florida Statutes, the Department shall address this in its 2019-2020 regulatory plan.
