    NOTICE OF CHANGE

    Notice is hereby given that the following changes have been made to the proposed rule in accordance with subparagraph 120.54(3)(d)1., F.S., published in Vol. 46 No. 247, December 22, 2020 issue of the Florida Administrative Register.

    The following sections of the proposed rule will be changed to read:

    59A-3.270 Health Information Management.

    (1) through (11) no change.

    (12) Each hospital must immediately notify a non-Medicare patient or their representative when the patient is placed on observation status. Notification must utilize the Hospital Outpatient Observation Notice, AHCA Form 3190-2000, April 2021 September 2020, incorporated by reference and available at https://www.flrules.org/Gateway/reference.asp?No=Ref-XXXXX.  The form is available online at http://www.ahca.myflorida.com/HQAlicensureforms.

    (a) through (b) no change.

    In addition to updating the form version and date, the following changes will be made to Quality Measures and Patient Safety Information, AHCA Form 3190-2001OL, April 2021.

    The text in the opening description will be changed to read:

    Patients admitted to the hospital for treatment of medical problems sometimes experience other serious injuries, complications, or conditions. Some patients may experience problems soon after they are discharged and need to be admitted to the hospital again. These events can often be prevented if hospitals follow best practices for treating patients.

    Changed language from SIR to benchmark and dropped the additional national benchmark score for clarity. The text in the Health Care Associated Infections (HAI) section will be changed to read:

    HAIs are infections that occur while a patient is being treated in a hospital. Many of these infections can be prevented through the use of proper procedures and precautions. Infection reports compare the infections at a hospital to a national benchmark.

    The text in the Hospital Consumer Assessment of Healthcare Providers and Systems (HCAHPS) section will be changed to read:

    Patient surveys measure satisfaction with hospital care, nurse and doctor communication, staff response to needs, and the cleanliness and quietness of the hospital.

    The description of the star-rating system in the Hospital Consumer Assessment of Healthcare Providers and Systems (HCAHPS) section will be changed to read:

    The star ratings range from - ★★★★★ stars.

    The text in the 15-Day Readmission Rate section will be changed to read:

    Patients should not normally be readmitted to a hospital within 15 days of a hospital stay for the same or a related condition. A low 15-Day readmission rate generally means the hospital is doing a better job of managing a patient’s condition and helping arrange proper post-hospital care coordination.

     

    In addition to updating the form version and date, the following changes will be made to Hospital Outpatient Observation Notice, AHCA Form 3190-2000, April 2021:

    The selections/check boxes in the first section of the Hospital Outpatient Observation Notice will be removed, providing a space for facilities to write the reason the patient is not an inpatient.

    The second section of the Hospital Outpatient Observation Notice will be changed to read:

    You are a hospital outpatient receiving observation services, also called an observation stay. You are not an inpatient because your provider requires further time to determine the severity of your illness and whether you will require hospitalization.

    • Your out-of-pocket costs for outpatient services may be different than those for inpatient services.

    • Contact your insurance provider to determine details of your coverage and other costs regarding observation status.

    • If you have any questions about your status, ask the hospital staff member giving you this notice or the doctor providing your hospital care. You can also ask to speak with a representative from the hospital’s utilization or discharge planning department.
