    40E-6.011Policy and Purpose

    NOTICE IS HEREBY GIVEN that on March 19, 2015, the South Florida Water Management District (District) received a petition for waiver from Frederick and Tanya McLendon (Application No. 07-0927-1) for utilization of Works or Lands of the District known as the North New River Canal for existing facilities consisting of a fence and trees within the north right of way of the North New River Canal; Section 12, Township 50 South, Range 40 East, Broward County. The petition seeks relief from subsections 40E-6.011(4) and (6), Fla. Admin. Code, which govern the placement of above-ground permanent and/or semi-permanent encroachments within 40’ top of canal bank within the works or lands of the District.
