PURPOSE AND EFFECT: The Tolomato Community Development District requests expansion of its boundary by adding 466.07 acres. As the boundary is set forth in rule, amendment to the rule is required to accomplish the expansion.

SUMMARY: Once established, section 190.046, FS, allows a community development district to expand or contract its boundaries upon submission of a Petition to the Florida Land and Water Adjudicatory Commission for approval. The Commission approved the District’s Petition on 3/9/21 to expand the District through rulemaking to add 466.07 acres to the existing boundary. The Commission Secretary was authorized to publish rulemaking notices to accomplish the rule amendment.

SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

However, a SERC was prepared at the request of the Tolomato CDD and is included as Exhibit 9 of the Petition.

The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: The Commission has determined that the proposed rule amendment is not expected to require legislative ratification based upon the statement of estimated regulatory costs completed at the request of the Tolomato Community Development District contained in the Petition to expand the District.

Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.
